Please read these Terms and Conditions carefully before using our services and website. By accessing the site or using the Services, you are contracting with Clobet Limited, a company incorporated under the laws of Malta, bearing registration number C 90546 and having its registered office at Fawwara Building, Triq L-Imsida GZR 1401 - Gzira - Malta. Clobet Limited provides the services to customers through the licence issued by the MGA:

“Malta Gaming Authority” or “MGA” means the regulatory body in Malta responsible for remote gaming conducted in Malta, in accordance with the Lotteries and Other Games Act, Chapter 438 of the Laws of Malta.

3. Licenses, regulations and standards

Clobet Limited adheres to, and complies with strict rules and regulations set by independent organizations that monitor and audit the games on our systems. These organizations also review the processes and the internal procedures of the site to ensure the highest industry standards are maintained and complied with. Clobet Limited is licensed, regulated and accredited by:

• Accredited IT Testing Laboratory: FACT Group Ltd.

3.1 Malta Gaming Authority

The Malta Gaming Authority (MGA) is the regulator for gaming industry operators conducting business from Malta. 3.3 PCI-DSS compliant

The Payment Card Industry Data Security Standard (PCI DSS), was developed by the Payment Card Industry Security Standards Council (PCISSC), a committee composed of the most important payment card companies. Clobet Limited complies with PCI DSS standards and is audited quarterly by a PCI Council Approved Scanning Vendor (ASV). Clobet Ltd also updates and files the statutory Self-Assessment Questionnaire (SAQ), a document that merchants are required to complete every year.

4. Definitions

• "Player(s)": A registered user of the website (also referred to as "you", "your", “player” or “customer”).
• "Website": The content in the licenced domain and any subdomains or related domains you may be redirected, including mobile websites managed by the Operator within the same or other domain or under the same or another brand.
• "Winnings": The return paid to the player with respect to a winning bet or in an instant win game, the prize money won by the player.
• "Winning Bet or Winning Entry": Is the successful outcome or positive result of a bet placed on a Source Lottery through use of the Website in accordance with these Terms and Conditions.
• "Bet Bonus": Funds or resources (e.g., additional bet/s or spin/s, tokens, points etc) that may be allocated and credited to a Player's account in accordance with the specific terms of a certain promotional campaign and which bonus funds or resources may be availed of by the player to place lottery and casino bets. Bonus funds must be wagered. Bonus funds cannot be withdrawn.
• "Syndicates": An organised group of individuals that combine resources to promote and pursue a common interest.
• "Source Lottery": A lottery that is managed and organized by an operator or body other than Clobet Limited. A player may place bets on the result of the lottery draw through this website. However, it is the third party organizing the source lottery that is responsible for successfully carrying out the draw, determining prizes, as well as guaranteeing compliance with the laws and regulations in force in the country where the lottery is organised.
• "Lottery Messenger Services": Through this service, the player places bets directly with the organizer of the lottery, under the same terms and conditions as any user who bets or purchases a lottery ticket in the country where that lottery draw takes place. Clobet Limited, through the web platform, provides an official lottery ticket issued by the organizer of the event. The ticket will be valid to claim a drawn and correctly determined lottery prize. To claim a winning prize, the rules contained in these terms and conditions must be observed.
• "Bet": Means the stake or contribution paid to participate in the outcome or result of a source lottery draw.
• "Ticket": Means a method of direct participation in the draw with the official organizer of the lottery.
• "Scratchcard Bonus": The scratch card assigned and credited to the player's account in accordance with a certain promotion.
• "User Account" or "Player Account": Is the account you need to open to use these services.
• "Inactive account": Means a player’s account which has not recorded any wager or deposit, for a period of 365 consecutive days or more.
• "Bet confirmed": A stake or ticket that has been validated or stamped correctly and that allows a player to participate in a draw or game linked to the wager.
• "Draw completed": A draw has been held, the validity of the game has been confirmed and the winners of the draw have been determined.
• Prize Groups in Class Type A: A Prize Category where the pay-out to the player depends on the number of Lottofy Winning Bets, winning bets within Lottofy's network of hedge providers and Underlying Lottery Winning Tickets in that Prize Category, as defined in section 19.
• Prize Groups in Class Type B: A Prize Category where the pay-out to the player depends on the number of Lottofy Winning Bets, winning bets within Lottofy's network of hedge providers and Underlying Lottery Winning Tickets in that Prize Category, as defined in section 19.
• Prize Groups in Class Type C: A Prize Category where the pay-out to the player is independent from the number of Lottofy Winning Bets, winning bets within Lottofy's network of hedge providers and Underlying Lottery Winning Tickets in that Prize Category, as defined in section 19.
• “Prize Category” or “Prize Tier”: The category relates to the number of correctly matched numbers (including Super Numbers, Stars, Euro Numbers, Powerballs, Megaballs and/or Bonus Balls as applicable) and which result determines the Prize Category in respect of the relevant draw of a certain lottery or a related game.
• "Winning Ticket": A verified and confirmed ticket drawn during an official draw of a lottery thereby resulting in a positive bet outcome for the ticket.
• “Source Lottery Operator”: The organisation that organises or co-organises the Underlying Lottery.
• "Player Account": the account created on the Website during the Player's registration process and through which account the Player may deposit funds, place bets, receive winnings and withdraw cleared funds.
• "Bank Account": An account held with a regulated and accredited financial institution, the details of which are provided by the player and which are linked to the player's gaming account.
• "Your Jurisdiction": Means the jurisdiction in which you are domiciled, reside or work.
• This "Agreement": Means these Terms and Conditions.

5. Services offered

5.1 The services

References to the "Services" or "Gaming Services" in these Terms refer to the provision by us of the gambling services and instant games services.

Gambling services:

Bet on Lottery Service: A service through which a player places bets on the outcome of lotteries. By betting on a lottery outcome, you do NOT participate in a lottery and you are NOT entering into any contract, agreement or transaction with the Source Lottery Operator. Through the bet on lottery service, you are entering into a contract with Clobet Limited. Clobet Limited provides all Lottery betting services exclusively from Malta.

Lottery Participation Service: A service through which you participate in the draw of an official lottery, by virtue of an official ticket generated by the operator of the source lottery. Clobet Limited shall be responsible for generating the ticket and storing it in its system. In this case, you are Clobet's customer and you would be utilising a service rendered by us. To make use of our services you must first accept these terms and conditions.

Instant games services:

This service consists of virtual games, the outcome of which is based on random number generators "iRNG".

5.2 Who offers the services

When using the service or services, you are contracting with Clobet Limited (a company incorporated under the laws of Malta, bearing company registration number C90546, with its registered office at Fawwara Building, Triq L-Imsida GZR 1401 - Gzira - Malta). Clobet Limited provides the Services to customers by virtue of the license granted to it by the Malta Gaming Authority as stated in section “2. Parties, above. Location: The placement and acceptance of all bets placed on lottery result outcomes is deemed to take place in the territory of Malta.

5.3 Who can use the services

Account registration by a player is only permitted if, at the time of registration, the person in whose name the account shall be registered, held and operated:

Is 18 years or older, provided that the eligible age to bet legally is 18 years.

If you reside or are physically located in a jurisdiction where the legal age to bet is not 18 years of age (e.g., 21 years of age), then to register an account, the player must be of legal betting age as required in that jurisdiction.

If you are under 18 and attempt to register an account on our site, the account shall be blocked to prevent any further use thereof. All bets placed (if any) shall be voided, any monies used to place bets shall be refunded and any winnings from any bets placed shall be forfeited.

Is not a citizen of, or resident in a country where access or use of the website and/or the services offered through the website, is illegal.

Please note that you are responsible for determining whether access to and / or the use of the services complies with the laws in force of your country and / or in your jurisdiction. By registering a player account and/or accessing the site, you confirm that your use of the services is not illegal in the territory from which you access them and/or is not illegal in the country of your citizenship.

Is not legally incapacitated.

Clobet Limited has the right to refuse to register an account and/or to close your user account. In the event that an account is closed, the money held in your account will be transferred to your bank account or the ' source of funds account' that was used to deposit the same funds to your user account. The contractual obligations in force at the time the user account is closed will be fulfilled unless there is a problem according to these Terms.

To use this site and the services, you must have a bank account, a valid credit or debit card, or an alternative payment method that is acceptable to us and is approved by a reputable financial industry regulatory authority. Furthermore, the financial institution where the bank account is held, and/or the issuer of the card and/or any other payment method used must also have a registered address located in a territory that is allowed to use the services of this website.

5.4 Provision of the services

If there are no legal or contractual restrictions, you may use the Gaming Services available through our website.

Notwithstanding the foregoing, occasionally we may suspend, remove, modify, or add to the Services. Any changes will be effective immediately and may even be made without any prior notice. If we make a change that affects a bet that you have placed, but which is still unconfirmed, your bet will be voided and the money shall be refunded and credited to your user account. An unconfirmed bet is one which our insurance provider, ticket supplier or the official organizer of the lottery draw would not have confirmed to us as having been registered or deposited correctly. We shall not be held responsible for any losses suffered by any changes to our services or services offered through our website/s.

We are committed to use measures at our disposal to enforce Clobet Limited's responsible gambling policy and other current player protection regulations. In the event that you deliberately avoid any implemented protective measures, we reserve the right to apply exceptional measures to ensure that you do not continue to aggravate your situation or harm yourself.

6. Player account

You are only allowed to register and use one account. If you attempt to register multiple user accounts, all the accounts you manage to open may be blocked or closed. If you have access to, or control more than one user account, notwithstanding that the user accounts are registered under different names or use variations of the same bio data, you must notify our "Customer Service Department" immediately so the matter will be addressed and rectified.

You must not use your account or the Services for any professional or commercial purpose. You must not allow anybody else to use your account. You must not access the Services through another person's account.

On this website, any player-to-player fund transfers are prohibited. The purchase, sale or trade in any manner or form of accounts belonging to other users is also strictly prohibited.

6.1 Sign-up

To register, you must provide the information requested in the online registration form in a complete, accurate and precise manner. It is your responsibility to ensure that the information provided is true, correct, and up to date.

All data provided in the form must be true and correct. You must fill in all mandatory information requested in the registration form. Requested information includes name, surname(s), date and place of birth, gender, address, fixed line and/or mobile phone number and a valid email address amongst other details. We may also request other information such as postal code, hobbies and interests, employer details, data/payment information, IP address, and other information relevant to customers that may be used to streamline our marketing offers and/or promotions based on any information you provide.

Note: First name and surname details should be your complete, official name and must match the name details on any official government issued ID document and form of payment you use to effect deposits and request withdrawals.

To complete your account registration, you must accept the "Terms and Conditions" and the "Privacy Policy" of this site. Before registering you should read both the "Terms and Conditions" and the "Privacy Policy".

When you register, you must create a username and a password that you shall use to log on to your account. The player must inform Lottofy immediately if he/she suspects that any information linked to their user account has been compromised in any way. It is imperative that you contact and inform Lottofy immediately, if any payment card details used on your account are lost, stolen or blocked, or if any password, PINs or other confidential information that may be used to gain access to the user account have become known to any third parties.

6.2 Age verification and identity verification

Once you have registered and successfully deposited funds, we may need to verify your identity and/or your age. Until all necessary verifications are completed, no withdrawals shall be allowed from your account. Furthermore, we may also take the following preventative action until the verification process is completed:

• Restrict access to your account until the requisite verification process is completed.
• Suspend your account.

If during the identity and/or age verification process we discover that you are not eligible to gamble, we shall refund your deposits and close your account. If any winnings were credited to your account, these would be forfeited due to breaches of the "Terms and conditions".

By registering and by accepting the “Terms and Conditions” and the “Privacy Policy”, you agree that we have the right to carry out checks and verifications to ensure and maintain the integrity of our gaming systems and to protect registered players. The checks we conduct are varied and may include, but are not limited to, identity and age checks, credit checks, source of funds and source of wealth checks etc. You hereby accept and consent that such due diligence checks may be carried out. Until any verification checks are completed satisfactorily, we may suspend or restrict access to your account.

Whenever you deposit an accumulated amount of €2,000 (Two Thousand Euros) during a 180-day period or €1,000 (One Thousand Euros) or more within a 24-hour time period, we may need to carry out verification or other required checks. To enable us to conduct the necessary checks, we may request you to provide us with additional information or documents to allow us to verify your identity, address, payment method, source of funds and wealth or any other ancillary documents that may assist us to conclude the required checks.

The documents that we are likely to request for verification of identity or source of funds and wealth checks include a valid photo ID document issued by your country's government, a utility bill, a verified payment card method, a banker's reference or check, an authenticated scan or photocopy of a credit card or a tax return, and an officially accepted document showing the origin of the funds deposited in your account.

Should we request you to provide documents for identity verification, we shall block any fund withdrawals until you submit the documents requested. If you do not provide appropriate documents within 30 days of our first request, or if any information or documentation is false, misleading or dubious, your user account shall be blocked and your funds may be forfeited.

We may provide your data to credit institutions or authorised credit agencies to verify and confirm your identity and/or the ownership of any payment method you use. You hereby agree that we may use this information for the purpose of carrying out these verification checks.

If your account is suspended, you must contact us and request your account to be unblocked.

6.3 Politically Exposed Person (PEP)

If you are, or think that you may be considered to be a Politically Exposed Person, you must notify Lottofy during the registration process by sending an email to [email protected] and disclosing any necessary information accordingly.

Lottofy may request additional information or documentation at any time to allow it to carry out any further verification or enhanced due diligence checks considered necessary. For your information we describe the definition of a PEP: Natural person who has developed a prominent public function that includes:

• Heads of State, Heads of Government, Ministers and Deputy and Assistant Ministers and Parliamentary Secretaries.
• Members of the governing bodies of political parties.
• Members of Parliament or similar legislative bodies.
• Members of courts of auditors, Audit Committees or of the boards of central banks.
• Members of superior, supreme and constitutional Courts or of other high-level judicial bodies whose decisions are not subject to further appeal, except in exceptional circumstances.
• Members of the administrative, management or supervisory boards of State-owned enterprises.
• Ambassadors, Charge D’Affaires and other high-ranking officers in the armed forces.
• Anyone exercising a function equivalent to those set out in paragraphs (a) to (f) within an institution of the European Union or any other international body.
• With respect to the term ‘immediate family members’ of PEPs the term shall include:
• The spouse, or a person considered to be the equivalent of a spouse, or a partner.
• The children and their spouses, or persons considered to be equivalent of a spouse; or the children's partners; and any of the parents or parents in-law or other in-laws.

6.4 Account details

You may access four general sections from your Lottofy account.

My account: Where amongst other information you may access your winning's summary, your group's activity summary. From this section you may also manage any automatic renewals.

Bets: Where you may view bets placed on the different games in which you participated, information of the day, week and month and the state of the game as well as the summary of the prize per game. You also have the possibility to access information specific to each bet and view any results.

Balance: Where you may access information about your account movements and options to effect deposits and request withdrawal of funds.

Settings: Where you have access to notifications, documents and configuration tools to set settings for player protection and betting limits;

Configuration: Where you have access to, and may amend your, access data, personal data and the currency in which you wish to make deposits and withdrawals (Once the currency is set, it cannot be changed). Through this section you may also close your account.

Notifications: Where you have access to configure notifications for any games that you would like to receive information about, for example information about jackpots, available games, games you have participated in previously and other similar notifications.

Documents: Where you may upload and access information regarding your various documents, e.g., identity card, driver's license, passport, source of income, images of credit / debit cards and bank account certificate, etc. Player protection measures: Where you may access and set your gaming account deposit and betting limits, select various game self-exclusion options, gaming session time limits as well as other player protection help measures and account suspension procedures.

Account details: You must keep your account information updated. If you need any assistance to access your account details, please contact our Customer Service Department.

Account access credentials: You must keep your password and all your account details secure and confidential at all times. You MUST NOT share or divulge any of your account access credentials. If your username and password have been entered correctly, any transactions effected on your account will be binding, irrespectively whether you have processed a transaction personally.

6.5 Inactive accounts and dormant accounts

An account is deemed to be “inactive” if during an uninterrupted period of 365 days none of the following transactions occur: Cleared funds are deposited into the account, or a bet/wager is placed and subsequently confirmed by the gaming system.

Lottofy reserves the right to charge an inactive account maintenance fee of €5 (Five Euros) per month provided there are funds in the account. Maintenance fees shall be debited to the account on the 1st of the month commencing immediately in the month following the day the account becomes inactive.

Inactive account maintenance fees may be reimbursed Clobet Limited considers that there are sufficient and justified reasons for an account to have lapsed into inactivity or if account inactivity was due to health reasons or other reasons of force majeure. Any decision to re-imburse any inactive account maintenance fees or any portion thereof that were debited to the account, will be at Clobet Limited's sole and absolute discretion.

An account may be re-activated by:

• Depositing cleared funds into the account.
• Placing a bet or wager that is confirmed by the system.

If your account remains inactive for an uninterrupted period of 30 consecutive months, your account shall become dormant. If a dormant account holds funds, we shall discontinue debiting monthly account inactivity charges to your account and we shall refund the residual balance held to your designated bank account as indicated in your account registration form.

If we are unable to contact you, we will transfer your balance to the MGA, in accordance with applicable laws and gaming regulations. In this case, your player account will not be closed and you may reactivate it at any time.

Thirty (30) days prior to an account becoming inactive, Lottofy shall attempt to notify the Player about the matter to allow the player to take any necessary action in due time. Players wishing to recover any funds held in inactive, dormant, closed, blocked, suspended or otherwise excluded accounts, should contact our Customer Service Department via the following email: [email protected]

6.6 Breach of Terms, penalties and account cancelation

At its sole discretion and at any time and for any reason whatsoever, Clobet Limited may suspend, block or close your player account.

In the event that your account is suspended, blocked and/or subsequently closed, we shall void your pending bets and after deducting any expenses which are due to us and that we may rightfully recover, we shall transfer the residual, cleared funds balance held in your account.

Irrespective of the abovementioned, we have the right to retain and/or block sufficient funds to recover any chargebacks, expenses, fines and/or penalties incurred for any reason, as well as, to recover any other bonus or promotional credits you may have obtained and for which the applicable promotional terms and conditions have not been fully satisfied or complied with.

Furthermore, should any of the following breaches or events occur:

• You do not qualify to avail yourself of, and/or to use our services.
• Unsuccessful verification of age and/or identity.

If we are requested to do so by any regulatory or judicial authority, or by the police or a tax authority or to comply with any law.

6.7 Account closure / account suspension

If you would like to close your account, you may do so at any time by contacting our Customer Service Department via email. If you close your account, the company will return all funds held in your account subject to the terms governing "withdrawals" and these terms and conditions.

Your account will not be closed if it has a negative balance. A negative balance in your player account can only occur in the event of a chargeback and must be settled immediately. 7. Player finances

Clobet Limited is not a financial institution, therefore it should not be treated as such. Your account is not an interest-bearing account and no interest shall ever accrue on any funds held in your account.

7.1 Deposits

• If the error is due to a connection failure, an attempt will be made to rectify the error prior to the draw or event taking place. If this is not a possible option, we may postpone the bet until the next lottery draw or event.
• If the error is related to an incorrectly sent email or an unsent email, the error shall be rectified.
• We shall endeavour to resolve any other errors or issues as fairly, as correctly and in the most equitable way possible for all parties.

9.4 Exceptional Circumstances in the Use of Lottofy

Listed below are a series of exceptional circumstances (this list is non exhaustive) which may lead to your bets being cancelled or rendered void. This is without prejudice to any other measures stipulated above:

• The result or outcome of the game, draw or event has been impacted or is affected in any way, by cheating, fraud or any other illicit or criminal activity.
• You or persons that may be linked to you have influenced the outcome of the game, draw or event in any way, whatsoever.

• You have charge-backed any previously made payments, have carried out payments using fraudulent methods or with cards that are not issued in your name or that you are not authorised to use.
• If you make any false accusations to any competent authority about any bet placed on a website owned or operated by Clobet Limited and those accusations are declared to be false, unfounded or non-existent by a competent authority or judicial court.
• Ticket or bet purchases were accepted when the site was subject to errors, system failures, interruptions, force majeure or other issues without the existence of which, the purchases would not have been accepted in the normal course of business.

Below is a list of exceptional circumstances (the list is not exhaustive), for which we reserve the right to withhold balances held in accounts, deduct balances from the player's account for expenses and fees incurred by Clobet Limited for these exceptional events and to initiate legal proceedings against any person, in order to limit and recover any potential or sustained damages of whatever nature:

10. Our liability

• Damage to, possible loss, or loss of reputation or goodwill.
• Unpredictable losses.
• For delays, losses, errors or omissions made by the postal or any other delivery service or by the banking system.

11. Anti-money laundering reporting

Clobet Limited shall review all potentially suspicious transactions and shall carry out any necessary verifications, at the company's own initiative or at the request of designated official regulatory bodies in order to confirm the correct identity of the player and the origin of any deposited funds.

Clobet Limited shall inform the FCU or other relevant authorities of Malta about any suspicious transactions involving any potential money laundering or terrorist financing.

12. Your obligations as user

Declaration and Warranties.

16. How we operate

Primarily, we operate as a bookmaker. Through our services, you may either:

• Place bets on the result of Lotteries organised in different jurisdictions or,
• Purchase tickets to participate in some of the largest and most popular lotteries.

Payment of winnings of successful bets are usually financed from own funds, however Grand prize pay-outs may be covered by insurance policies underwritten in the normal course of business specifically to manage the risk of a substantial liability materialising.

In some cases, we can buy real tickets in the Source Lottery. Should your Source lottery ticket be the winning ticket, we may need your assistance to claim the lottery prize. In this case, you agree to extend the necessary assistance to help us claim the lottery prize, at the time we request it.

If Source Lottery winnings are subject to deductions of any kind (for example withholding tax, tariffs, duty, liens etc), such amounts shall either be:

• Deducted from your prize winnings or,
• They shall be deducted from your account.

We are under no obligation whatsoever to pay you any monies deducted from source lottery winnings.

Small prize winnings are paid out to a player's account immediately after the draw is held and/or the event ends.

Grand Prizes must be claimed within 3 months after the draw is held or the event has ended.

If you buy multiple tickets or place multiple bets with the same numbers, you are only eligible to win the applicable Grand prize once, irrespective of the number of tickets or bets placed for that particular lottery or event. On the other hand, you are entitled to multiple smaller prize winnings if you have several winning tickets or placed bets with the same numbers in the particular event.

Category A and B Grand prizes must be claimed as stipulated in this section. Clobet Limited shall make all reasonable efforts to obtain the amount of major prizes. The player accepts and agrees that prize payments may be delayed until Clobet Limited receives the funds itself.

Delays may be encountered in the event that Clobet Limited is constrained to initiate legal proceedings to claim and obtain prize monies.

16.1 How are winnings calculated

When the Source Lottery draw is held or the event is concluded, we shall proceed to determine the results of the correct bets and compute the total corresponding prize winnings. This process requires a significant amount of time and notwithstanding our very best efforts to conclude the process in a timely manner, certain delays may be encountered.

Bet results and winnings are computed on the following basis:

• Depending on the game format: (see section: 17. Game Modes).
• Depending on the type of game (see section: “18. Games”) and maximum possible winnings (see section: “19. Maximum Winnings”).
• Depending on any withheld prize money (see section “20. Winnings Retention”).

Winnings are computed using the Source Lottery's stipulated currency but are credited to the player's account in Euros (the reference currency). The currency conversion rate used is the applicable reference rate determined by the European Central Bank and published on www.xe.com on the date of the Source Lottery draw.

The jackpot amount for each draw or event will be displayed on the website. There may be instances when the jackpot amount for a particular draw is not displayed. This may be due to a technical fault, an error or because the Source Lottery Operator has not published it.

The Jackpot for each draw or event will usually appear on the game form at the start of the gaming period. A jackpot may be subject to changes due to human or technical error. Source Lottery operators may also update to jackpot amounts. We assume no responsibility whatsoever for any such changes or amendments to jackpots.

You agree and accept that the final Jackpot of a draw or of an event and final Gran Prizes are those announced after final verifications or scrutiny of a draw or an event are concluded. 17. Game modes

It is important to take note of the clauses and provisos listed under sections: "18 Games", "19 Maximum Winnings" and "20 Winnings Retention".

17.1 Individual bets

When placing bets on an individual basis, the player participates in the game personally and it is the individual player who chooses the numbers of the bet.

The player may participate with one or several simple bets by filling in the main numbers and special numbers (if they exist in the corresponding game).

The player selects which draws and/or events he wishes to participate in and also the number of weeks he would like to continue participating for.

The player may also select an "Automatic Renewal" option. The "Automatic Renewal " option rules appear by clicking on the corresponding form. The rules are also listed under section 8.1 "Placing bets/wagers" subsection 2 "Automatic Renewals".

To complete the purchase of the ticket or bet, the player must click on the "Purchase" option and follow the instructions provided.

In a game form, the player has access to the various betting options available (e.g Single, Multiple, Reduced or Optimized Formulas).

Individual Bet Winnings are determined based on the type of game and in accordance with the terms, conditions and provisions listed under sections “18. Games Modes”, “19. Maximum Winnings” and "20 Amount Withheld”.

17.2 Betting fund

A "Betting Fund" option is available for all types of lottery games.

“Betting funds” may be described as syndicates where a player still chooses his individual bet/s.

Betting fund participating players select their own bet numbers and the quantity of stakes they would like to purchase. The purchased bets are then added to a common pool.

If a player's selected bet ticket is the winning bet, the player would share half their prize money with the other betting fund participants. Apart from the half share of prize money, the owner of the winning bet would also receive a percentage of the betting fund's 50% shared winnings, pro-rata basis to the number of bets he placed.

The betting procedure is similar to the "Individual Bet" option, the only difference being that when effecting payment, the player simply adds his bets to a corresponding "Betting Fund".

Below is an explanation illustrating how winnings are distributed in a Betting Fund:

• Betting Fund "X" has placed wagers on a cumulative total of 100 bets purchased by the various fund participants. A fund participant, "Player "A" has one correct bet with 1,000 euros in total winnings.
• Player "A" has contributed to the fund by purchasing three (3) bets out of the 100 accumulated bets that the Betting Fund has wagered. Player "A" has one (1) winning bet with total prize monies of 1000 Euros, of which 500 euros (50% share of winnings) are credited to Player "A" and Eur 500 are distributed pro-rata amongst all the Betting Fund players.
• Therefore, out of the Eur 1000 prize winnings, Player "A" has a right to:
  • 500 euros (50% share) of the winning prize amount and a pro-rata percentage of the group winnings computed on the basis of betting contributions.
  • From the residual winnings balance of Eur 500 which is split amongst all the Betting Fund participants, Player "A" has a right to another 15 euros, computed as follows:

1. 500 euros (50% Betting Fund group share of prize winnings) / 100 bets = 5 euros pro-rate winnings per bet placed.
2. The total winnings distributed to Player "A" (500 + 5*3 bets) = 515 euros

Betting Fund winnings are determined as illustrated above and according to the type of game and the provisions contained in sections “18. Games Modes”, ”19. Maximum Winnings” and “20. Amount Withheld”.

17.3 Syndicates

Through syndicate bet participation, a player does not own specific bets. Instead, the player purchases the syndicate's shares and participates, based on the shares purchased, in the pool of bets placed by the syndicate, determined entirely by Clobet Limited, at its sole discretion. It is the syndicate that actually participates in the draw or corresponding event of a game.

When purchasing syndicate bet shares, the player enters into a betting contract directly with Clobet Limited.

If the Syndicate through which the player purchases bet shares, has a successful wager, the winnings derived from the Syndicate's bet:

1. are split pro-rata on the basis of total shares purchased by a player in relation to the total bet shares held by the syndicate group and,
2. subject to any other corresponding clauses of these Terms of Service.

Since a player purchases shares in a syndicate bet, a participating player does not have the option of selecting his preferred bet numbers.

The number of shares available in any Syndicate increases based on the sales of shares by that Syndicate. The Syndicate may offer and sell participating shares until the closing date of the corresponding event, lottery draw or game.

If the available shares are taken up prior to the closing date of the corresponding event, lottery draw or game, the Syndicate will simply increase the number of available shares and automatically adjust the participating share percentages held in the Syndicate.

Share increments may take place until the closing date of the corresponding lottery draw, event or game.

For each type of game there would be a minimum of one Syndicate.

Participating shares in Syndicate bets are displayed in the "My Bets" section of a Player's Account.

An email is also sent to the player confirming the purchase, the quantity of shares and details of the bet share.

Once the draw or event is held, another email is sent with information of the results obtained, the total winnings if any, of the Syndicate, and the winnings amount due to the player.

Bet share winnings are determined on the basis of game type and are also subject to the terms, conditions and provisions listed under sections “18. Games Modes”, “19. Maximum Winnings” and "20 Amount Withheld”.

17.4 Betting groups

Betting Groups are groups of players that share their bet wagers to participate in lottery draws, events or games.

The concept of a betting group is that individual participants contribute monetary amounts which are used to fund selected bet number combinations. These bets are then wagered on behalf of all the group's participants.

Winnings derived from betting group wagers are split amongst all the group members in proportion to the amounts they contribute individually.

You may form a betting group with friends and/or family members, create a public group for anyone to join or join a public group:

• Setting up: the administrator sets up, names the group and specifies whether the group is public or private. The group administrator/s stipulates the lottery draws, betting and game types and events that the group shall participate in.
• Configuration: the group administrator/s selects the "Main game". The main game will determine the required minimum monetary contribution to participate in group wagers.
• Participation: Group participants will contribute their share of money ("the contribution") they wish to participate with. The Contribution is always a price multiple computed on the basis of the main game. The administrator/s will then use the contributions to select wager combinations.
• Selection of bets: the administrator/s will select the group's bet combinations and the different draw types in which to participate in. This may be done at any time prior to the draw or event cut-off time. Which combinations may the administrator/s select?

What happens if the administrator fails to select the bet combinations?

What happens if the group's betting wallet balance is less than the price of a bet combination? 19.1 Calculation Winnings Maximum

Lottofy calculates the winnings for each successful bet in the original currency used by the Source Lottery. The computation varies according to the type of game, class, category and game mode.

A successful bet shall be assigned to a prize category depending on the combination and number of matches with the Source lottery's winning numbers.

When a category has two sets of numbers in parentheses, The first number set represents the main numbers whilst the second number represents the special numbers. If one number is listed in brackets, no Special Numbers are applicable.

Depending on the prize class to which a prize category belongs, a formula is applied to calculate applicable prize winnings. The same formula applies to class Type A and B. The computation applicable to Class Type C is different however.

Source Lottery rules related to the mandatory distribution of jackpots to lower prize category levels, in the event that there is no source lottery official jackpot winner are not applicable. For the calculation of winnings, we assuming that jackpot amount has not been distributed to lower prizes levels.

For prize levels below Type A, the following are applicable:

In the event that a Source lottery distributes the 'A' class type prize (the superior prize category) to a lower prize category, Lottofy would still compute the superior class type prize amount on the basis of the theoretical value that would have been originally assigned to the prize level type by the Source Lottery.

Winnings for Prize Groups in Class Type A

Winnings = The Source Lottery Jackpot within the Prize Category 1st / (Number of Source Lottery Prize Tickets within the Prize Category 1st + Number of successful bets from Lottofy and Clobet Limited's network of hedge providers, within the prize category 1^st).

Example A.0.1

• The Source Lottery's main prize for the 1st Category Prize Group of Class Type A is EUR 3,000,000.00
• The Source Lottery Operator does not announce any (0) winning ticket for the Category 1st Prize Group.
• In Lottofy's lottery betting game and in the network of hedging providers, there is one (1) correct bet slip amongst the 1st Category prize group.

Example B.2.1

• The Source Lottery's prize for the 2nd (or 3rd) Category Prize Group of Class Type B is EUR 300,000.00
• The Source Lottery Operator announces two (2) winning tickets for the Category 2nd (or 3rd) Prize Group.
• In Lottofy's lottery betting game and in the network of hedging providers, there is one (1) correct bet slip amongst the 2nd (or 3rd) Category Prize Group of Class Type B.
• The winnings pay-out for the successful bet on Lottofy is EUR 100,000 computed as follows: Winnings pay-out = EUR 300,000 / (2 + 1).

Winnings for Prize Groups in Class Type C

Winnings = The Source Lottery prize category in which the successful bet was placed.

If a successful bet for a Prize Category is ranked in Class Type C, the applicable winnings amount shall be equivalent to the prize payable by the Source Lottery Operator for the corresponding Source Lottery Prize Ticket, that is the winning amount would be equivalent to that which the player would have received if they had the winning source lottery ticket.

Example C

• If in the draw for Game X today, the Source Lottery operator has announced that the prize for the 4th category (within the Type C Class) is € 1,250.
• The prize that will get a winning bet on Lottofy for the same category 4th, it is € 1,250.

If the Source Lottery Operator does not announce winning tickets in the Class Type C prize category, the winnings that will be paid in that category to each winning bet, will be based on total bets announced by the Source Lottery Operator and the distribution of prizes to the winning categories announced by the Source Lottery Operator.

If the Source Lottery Operator reserves the right to pay winnings either as a cash prize or as a free game, Lottofy shall also reserve the right and may determine at its sole discretion whether the winnings pay-out shall be in cash or as free game.

19.2 Winnings sharing between Game Mode

The procedure to distribute the winnings to each player according to the different games forms is:

1. Once the corresponding draw has been celebrated by the Source Lottery Operator, we make a provisional calculation of winnings that corresponds to each player is made. This calculation is for informational purposes only and is provisional, not final and firm until Lottofy receives all winnings from the Source Lottery Operator or the insurer.
2. Received (from Source Lottery Operator or the insurer) the winnings corresponding to each winning bet, the final calculation of the winnings by type of game and category of prizes according to section “18. Games”.
3. Next, the maximum winnings that correspond to each winning bet are determined according to the section “19.1 Calculation Maximum Winnings” and the Withholdings and deductions are deducted as set forth in section 20. “Winnings Withholding”
4. Once we have determined the net prize corresponding to each bet, it is distributed among the players taking into account the Game Mode, see section “17. Game Modes The calculation is performed as follows:

19.2.1 Individual bets

A player may participate in a lottery game by placing bets on an individual basis. Bets may be placed either as single or multiple bets and may be selected in different modalities.

Net winning pay-outs shall be credited to the player's account after subtracting any applicable withholdings or deductions due and as stipulated in sections 18 “Game Modes”, 19.1 “Maximum Winnings” and 20 “Withholdings”.

19.2.2 Betting fund

The distribution of prizes in the Betting Fund is carried out as follows: Each player who participates in the fund, gives half of his prize to the prize pool which is in turn distributed in proportion to what each participant has played, including the player himself.

Example distribution of winnings in a Betting Fund:

• Fund "X" has placed 100 lottery bets and accumulates net winnings amounting to EUR 1,000.
• Player “A” contributed one (1) bet to the bets placed by Fund “X”.
• Player “A’’ bet is correct and declared as a winning bet.
• Player “A” ticket has Euros 1,000 in provisional winnings. For the purposes of this example, for the sake of understanding this mode of gaming, we assume that there has only been one winning bet in Fund "X", which is equal to Player "A"' EUR 1000.
• The final prize pay-out is split as follows:
• Euro 500 (50% of the prize value) is allocated to the Betting Fund for further distribution amongst all fund participants in proportion to the bets each participant placed.
• Of the Euro 500 allocated to the betting fund prize winning, Player “A” receives EUR 5 (Fund prize share (EUR 500/100 bet fund participating tickets) * 1 ticket held by player “A”.
• The residual winnings of EUR 500 from Player “A" winning bet (50% of the winning bet) belong exclusively to this player.
• The total winnings distributed to Player “A” amount to EUR 505.

19.2.3 Syndicates

With Syndicates, each player does not own individual bets, but purchase shares to participate in a draw or corresponding event of a Game. The net winnings after deduction of Withholdings and deductions as indicated in sections “18. Games modes”, section “19.1 Maximum Winnings” and what is indicated in section “20. Winnings Withholding”, are distributed proportionally to number of shares held by each player in relation to the total shares of Syndicate participates in the corresponding draw.

19.2.4 Betting groups

Betting Groups are groups of players that share their bet wagers to participate in draw or events. You can form a group with your friends and/or family members, create a public group.

The net winnings after deduction of Withholdings and deductions as indicated in sections “18. Games Modes”, section “19.1 Maximum Winnings” and what is indicated in section “20. Winnings Withholding”, are distributed proportionally to number of shares held by each player in relation to number of total shares with which the Betting Group participates in a draw.

20. Withholdings and deductions on prizes

The percentage of withholding and/or deduction stipulated in the jurisdiction where the Lottery Source or the insurer is based shall be deducted from the prize amounts in accordance with the tax criteria of the applicable tax legislation.

The applicable withholding percentage as stipulated by Maltese legislation shall be deducted from Instant Game Winnings or winnings derived from games or lotteries that are not linked to, or based on a Lottery Source.

The applicable withholding or deduction percentage on prizes is intended to place players in a financial situation similar to that which they would be in, if they had participated in the Source Lottery and the Source Lottery operator had withheld such amounts from the prize winnings.

20.1 Prize payment options for PowerBall and MegaMillions Type 1 Category Prizes

The pay-out type and method are Lottofy’s exclusive decision. There is only one pay-out option for Powerball and Megamillions prizes and this is by a single lump sum payment.

Deferred payment options are not possible.

Using the single payment option and in accordance with the stipulated and effective Source Lottery operator (MUSL) rules, the winning prize gross pay-out is subject to a 40% deduction or such other higher percentage as applicable and/or as announced by the source lottery operator.

The above-mentioned single lump sum deduction is applied prior to any withholding tax dues.

For example, for a lump sum payment of gross prize winnings amounting to USD$ 60,400,000 (US$ 60.4 million), the net prize winnings payable would be USD$ 36,240,000 (US$ 36.24 million).

Furthermore, the withholding tax percentage as applicable in the source lottery's or insurance's jurisdiction is then deducted from the player's winnings.

20.2 Prize withholdings for Powerball and MegaMillions

Provided we receive the prize from the Source Lottery or the network of hedge providers of Clobet Limited, a deduction of 39.6% (or any other higher percentage determined by the MUSL) of the prize value shall be withheld prior to pay-out of winnings.

The applicable withholding or deduction percentage on prizes is intended to place players in a financial situation similar to that which they would be in, if they had participated in the Source Lottery and the Source Lottery operator had withheld such amounts from the prize winnings.

The withholding or deduction of prize monies occurs prior to the choice of payment options as described in the previous section “Prize payment options in Powerball and MegaMillions”.

Example: For a Powerball or MegaMillions Type 1 Category prize (Jackpot) amount to USD$ 100,000,000 the winner may receive a prize of USD$ 60,400,000. Under Single Payment Option 1, the player would receive a net lump sum prize pay-out of USD$ 36,240,000

For a Powerball or MegaMillions Type 2 Category prize amounting to USD$ 1,000,000 the winner would receive a prize of USD$ 604,000.

For a Powerball Type 3 Category prize amounting to USD$ 50,000 the winner would receive a prize of USD$ 30,200.

For a MegaMillions Type 3 Category prize amounting to USD$ 10,000 the winner may receive a prize of USD$ 6,040.

20.3 Prize withholdings for Euromillions

In order to carry out the application of the withholdings to levied in Euromillions, the withholdings on lottery prizes established by the Spanish tax authority and practised by the Spanish Lottery operator (SELAE) shall be taken into account.

Provided we receive the prize from the Source Lottery or from Clobet Limited's network of hedging providers, a deduction of 20% (or any higher percentage as determined by the competent Spanish tax authority) will be withheld prior to pay-out of winnings. The prize amount, above which this withholding takes place, is EUR 40,000, therefore for lower amounts, no withholding of prize amount applies.

20.4 Prize withholdings for Eurojackpot

In order to carry out the application of the withholdings to be levied in Eurojackpot, the withholdings on lottery prizes established by the Spanish tax authority and practised by the Spanish Lottery operator (SELAE) shall be taken into account.

Provided we receive the prize from the Source Lottery or from Clobet Limited's network of hedging providers, a deduction of 20% (or any higher percentage as determined by the competent Spanish tax authority) will be withheld prior to pay-out of winnings. The prize amount, above which this withholding takes place, is EUR 40,000, therefore for lower amounts, no withholding of prize amount applies.

20.5 Prize withholdings for El Gordo de la Primitiva

In order to carry out the application of the withholdings to be levied in El Gordo de la Primitiva, the withholdings on lottery prizes established by the Spanish tax authority and practised by the Spanish Lottery operator (SELAE) shall be taken into account.

Provided we receive the prize from the Source Lottery or from Clobet Limited's network of hedging providers, a deduction of 20% (or any higher percentage as determined by the competent Spanish tax authority) will be withheld prior to pay-out of winnings. The prize amount, above which this withholding takes place, is EUR 40,000, therefore for lower amounts, no withholding of prize amount applies.

20.6 Prize withholdings for Primitiva

In order to carry out the application of the withholdings to be levied in Primitiva, the withholdings on lottery prizes established by the Spanish tax authority and practised by the Spanish Lottery operator (SELAE) shall be taken into account.

Provided we receive the prize from the Source Lottery or from Clobet Limited's network of hedging providers, a deduction of 20% (or any higher percentage as determined by the competent Spanish tax authority) will be withheld prior to pay-out of winnings. The prize amount, above which this withholding takes place, is EUR 40,000, therefore for lower amounts, no withholding of prize amount applies.

20.7 Prize withholdings for Bonoloto

In order to carry out the application of the withholdings to be levied in Bonoloto, the withholdings on lottery prizes established by the Spanish tax authority and practised by the Spanish Lottery operator (SELAE) shall be taken into account.

Provided we receive the prize from the Source Lottery or from Clobet Limited's network of hedging providers, a deduction of 20% (or any higher percentage as determined by the competent Spanish tax authority) will be withheld prior to pay-out of winnings. The prize amount, above which this withholding takes place, is EUR 40,000, therefore for lower amounts, no withholding of prize amount applies.

20.8 Prize withholdings for Loteria Nacional

In order to carry out the application of the withholdings to be levied in Loteria Nacional, the withholdings on lottery prizes established by the Spanish tax authority and practised by the Spanish Lottery operator (SELAE) shall be taken into account.

Provided we receive the prize from the Source Lottery or from Clobet Limited's network of hedging providers, a deduction of 20% (or any higher percentage as determined by the competent Spanish tax authority) will be withheld prior to pay-out of winnings. The prize amount, above which this withholding takes place, is EUR 40,000, therefore for lower amounts, no withholding of prize amount applies.

20.9 Prize withholdings for El Niño Draw

In order to carry out the application of the withholdings to be levied in El Nino Draw, the withholdings on lottery prizes established by the Spanish tax authority and practised by the Spanish Lottery operator (SELAE) shall be taken into account.

Provided we receive the prize from the Source Lottery or from Clobet Limited's network of hedging providers, a deduction of 20% (or any higher percentage as determined by the competent Spanish tax authority) will be withheld prior to pay-out of winnings. The prize amount, above which this withholding takes place, is EUR 40,000, therefore for lower amounts, no withholding of prize amount applies.

20.10 Prize withholdings for Loteria de Navidad

In order to carry out the application of the withholdings to be levied in Loteria de Navidad, the withholdings on lottery prizes established by the Spanish tax authority and practised by the Spanish Lottery operator (SELAE) shall be taken into account.

Provided we receive the prize from the Source Lottery or from Clobet Limited's network of hedging providers, a deduction of 20% (or any higher percentage as determined by the competent Spanish tax authority) will be withheld prior to pay-out of winnings. The prize amount, above which this withholding takes place, is EUR 40,000, therefore for lower amounts, no withholding of prize amount applies.

20.11 Prize withholdings for Quiniela

In order to carry out the application of the withholdings to be levied in Quiniela, the withholdings on lottery prizes established by the Spanish tax authority and practised by the Spanish Lottery operator (SELAE) shall be taken into account.

Provided we receive the prize from the Source Lottery or from Clobet Limited's network of hedging providers, a deduction of 20% (or any higher percentage as determined by the competent Spanish tax authority) will be withheld prior to pay-out of winnings. The prize amount, above which this withholding takes place, is EUR 40,000, therefore for lower amounts, no withholding of prize amount applies.

20.12 Prize withholdings for SuperEnalotto

In order to carry out the application of the withholding taxes to be levied on SuperEnalotto, the withholding taxes on lottery prizes established by the Italian Tax Administration and applied by the Italian lottery operator (SISAL) shall be taken into account.

Provided we receive the prize from the Source Lottery or from Clobet Limited's network of hedging providers, a deduction of 20% (or any higher percentage as determined by the competent Italian tax authority) will be withheld prior to pay-out of winnings. The prize amount, above which this withholding takes place, is EUR 500 therefore for lower amounts, no withholding of prize amount applies.

21. Information about taxes in country of residence.

Jackpot amounts published on Lottofy's gaming website are stated gross of any applicable tax at source.

The final objective of deducting or withholding tax at source is to place players in a similar financial position to that which they would have been in had they participated in the Source Lottery, or to account for the amount withheld by the Source Lottery Operator or the insurer.

Depending on the player’s country of residence, prizes or winnings may be subject to other local, federal and/or state taxes.

Taxes which are not deducted at source or referred to as “other local taxes” differ based on a player's country of residence.

Any local taxes that players may be liable and subject to in their country of residence are the sole responsibility of each player.

Clobet Limited and/or Lottofy shall not be held responsible or liable for any local/federal/state or other local taxes or deductions that are due on any player winnings.

Players should consult with or seek advice from a tax professional when receiving substantial amounts of prize monies.

Players must consult and/or refer to the tax rules applicable in their country of residence to prize monies or winnings.

22. Security information

Protecting your computer is strongly recommended and advisable

Action should be taken to protect your computer from any malicious attacks by hackers who may either attempt to access personal and /or banking information that may be stored on your computer or may attempt to attack and access other 3rd party computers through your personal computer.

To avoid computer hacking attempts, anti-virus, anti-spyware and firewall software may be installed. When such software is installed and kept updated, unauthorised computer access is restricted.

Be careful when accessing or clicking links included in emails or webpages, which are not trusted, as they could be false or include malicious software. Access to Clobet and/or Lottofy accounts should be avoided from any computers located in public places allowing free access to the internet.

Use of a secure password is strongly recommended and advisable

A password containing 8 or more characters should be used. The password should consist of letters, numbers and special characters. The use of dates, names or data that may be common knowledge or known by third parties should be avoided.

Personal data, passwords and bank details should always be protected.

Clobet staff shall NEVER ask you to confirm user account or password details.

Lottofy will NEVER send you an e-mail, SMS, or leave a voicemail message requesting any username, password, bank details, card details, etc.

In the event that you suspect that your Lottofy account details have been compromised or otherwise obtained by third parties, please contact Lottofy's Customer Service Department as soon as possible.

Taking precautions during log in and log out

After visiting or accessing Lottofy's website, you should close an active session by using the close session icon located in the user panel.

The 'Log out' action prevents unauthorised parties from gaining access to a player's personal account details as registered on Lottofy's site and/or even avoid theft occurring via access to and/or from a player's account and/or the website.
